1. CONCLUSION OF THE AGREEMENT
The fol­lo­wing terms and con­di­ti­ons will apply if you place an order with us. Please read them carefully. Deli­ve­ries shall be gover­ned exclu­si­vely by the fol­lo­wing gene­ral terms and con­di­ti­ons, which form the basis for all agree­ments con­clu­ded on the basis of the goods and ser­vices offe­red in the FROZEN PALMS online store.

2. ORDER ACCEPTANCE
We reserve the right to refuse orders. This deci­sion is at the dis­cre­tion of FROZEN PALMS. If an order is not accep­ted, we will notify you of this by e-mail. We will inform you by e-mail in the event that we are unable to accept your order.

3. PRODUCT INFORMATION
Frozenpalms.com dis­plays the pro­ducts cle­arly and true-to-life. Howe­ver, FROZEN PALMS can­not gua­ran­tee that images and colors dis­played on the customer’s screen will exactly cor­re­spond to the actual pro­ducts. Your brow­ser type and moni­tor may affect the colors and images displayed. By submitting the order you approve the size, material, color and design. 

4. PAYMENT
All pri­ces are in EURO, VAT incl. Customs duties or other local taxes may have to be paid to the courier upon delivery of your order. They will be payable by the customer and raise of its whole responsibility as well in terms for declarations as for payments to the authorities qualified organisms for your country. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.  Please contact us by phone or e-mail if you prefer to pay via bank transfer, you will receive 2% discount on any bank transfer payments. The goods remain our pro­perty until com­plete payment.

5. STATUTORY RETURNS POLICY
RIGHT OF RETURN
FROZEN PALMS makes every effort to accommodate product returns with a generous return policy. However if an item is customized or made to order, such as an hand knotted or hand tufted rug, FROZEN PALMS cannot cancel the order after 48 hours of placement or accept a return. Other goods recei­ved may be retur­ned (not worn / not was­hed) wit­hin 7 days.
The 7-day period begins upon rece­ipt of return request in writ­ten form (e.g. by let­ter, or email at info@frozenpalms.com 
Sen­ding the goods or notice wit­hin this period is suf­fi­ci­ent. Returns should be sent in original package to address stated by FROZEN PALMS.
FROZEN PALMS does not cover any return shipping costs.

6. CONSEQUENCES OF RETURNS
In the event of the effec­tive return, the ser­vices recei­ved by both par­ties are to be retur­ned and any bene­fits obtai­ned (e.g. use bene­fits) are to be sur­ren­de­red. In the case of dete­rio­ra­tion of goods, repla­ce­ment value may be clai­med. Obli­ga­ti­ons to reim­burse pay­ments must be ful­fil­led wit­hin 30 days. The dead­line begins upon sen­ding the goods.
END OF RETURNS POLICY

7. WARRANTY
War­ran­ties for any deficiencies of the purchased goods are deter­mined by legal
requi­re­ments. FROZEN PALMS applies the Swedish Consumer Purchases Act. All products ordered via FROZEN PALMS have a 1 year manufacturer’s warranty against faulty craftsmanship. Non-Transferability: These warranties are extended only to the original purchaser and are not transferable. Warranties are not applicable to items sold as second quality, irregular, used or mill end. These terms are construed in accordance with Swedish law and Swedish Law shall apply.

Consequential or Incidental Damages: WE EXCLUDE AND WILL NOT PAY CONSEQUENTIAL OR INCIDENTAL DAMAGES UNDER THIS WARRANTY. By this we mean any loss, expense, or damage other than to the item itself that may result from a defect. Including, without limitation, trip charges, delivery delays, extra handling and labor involved in bordering or sculpturing. Colors are subject to different dye lots and may vary from pictures displayed on www.frozenpalms.com.

Your rug warranties DO NOT COVER:
- Damage resulting from carelessly opening the shipping packaging that the rug is delivered in, i.e. knife cuts.
 
- Damage resulting from any accidents or mishandling such as staining, soiling,
burning, flooding, cutting, and damage caused by pets, staining from common
household food or beverage substances.
- Damage or appearance issues on rugs installed on stairs, in bathrooms, or in kitchens.
- Problems caused by wetting or persistence of excessive moisture.
- Damage or appearance problems due to client's own choice of material.
- Changes in carpet color resulting from external causes, such as fading due to sunlight, lights, ozone, or spills of household chemicals and other non-food and non-beverage substances.
- Differences between the color and texture of the image shown on www.frozenpalms.com and the actual rug.
- Marks on the floor by unremoved rug protection tape.
- Problems caused by improper installation.
- Deterioration of anti slip padding that might appear over time.
- Yellowing, shedding or crushing.
 
8. WASHING AND CARE INSTRUCTIONS
The customer’s atten­tion is drawn to the washing and care instruc­tions sta­ted on the pro­duct labels. FROZEN PALMS shall not assume any lia­bi­lity for dama­ges resul­ting from incor­rect treatment.

11. AMENDMENTS AND UPDATES
These gene­ral terms and con­di­ti­ons will be updated from time to time. The new
gene­ral terms and con­di­ti­ons apply from the date of publi­ca­tion on
www.frozenpalms.com.
Should any pro­vi­sion of the agree­ment or of the gene­ral terms and con­di­ti­ons be or become inva­lid, or if the agree­ment is incom­plete, the rema­in­der of the agreement shall not be affected.

12. RESPONSIBILITY
Frozen Palms / frozenpalms.com will not be held responsible for the inexecution of the contract concluded in the event of unavailability or out-of-stock condition of the product, of cause beyond control, disturbance or all-out strike or partial in particular of the mail service and means of transport and/or communications, flood, fire. Frozen Palms / frozenpalms.com will not incur any responsibility for all consequential damages because of present, trading loss, loss of profit, loss of chance, damage or expenses.

13. IMAGE & CONTENT RIGHTS
All images and con­tent used on the Inter­net may be used only by FROZEN PALMS or its part­ners. Any unaut­ho­ri­zed use is prohibited.

14. DISCLAIMER FOR EXTERNAL LINKS
On www.frozenpalms.com, FROZEN PALMS may link to other web­sites (“exter­nal links”). FROZEN PALMS expressly decla­res that it has no con­trol whatsoever over the design and con­tent of these lin­ked sites. We hereby exclude all lia­bi­lity regar­ding these lin­ked pages. The owners of the respec­tive web­sites are solely responsi­ble for the con­tent of their pages. We hereby also expressly dis­tance our­sel­ves from the con­t­ents of all third party pages lin­ked to  FROZEN PALMS and do not accept these con­t­ents as our own.
